Terms of Service

Please read these Terms of Service carefully before using Specta. By using the platform, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using Specta, you agree to be bound by these Terms of Service and our Privacy Policy (available at specta.com.au/privacy), which is incorporated into these Terms by reference. If you do not agree, do not use the platform. We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of Specta after changes take effect constitutes your acceptance of the updated Terms.
2. The Specta Platform
Specta is an online marketplace that connects property buyers, renters, and investors ("Clients") with qualified home inspectors ("Inspectors"). Specta facilitates connections, communications, and payment processing between users. Specta is not a party to any inspection agreement entered into between a Client and an Inspector. We do not perform inspections, and we are not responsible for the quality, accuracy, or outcome of any inspection or report. The contract for inspection services is solely between the Client and the Inspector.
3. Accounts
You must create an account to use most features of Specta. You agree to: • Provide accurate, current, and complete information when registering • Maintain and promptly update your account information • Keep your login credentials confidential • Notify us immediately of any unauthorised use of your account You are responsible for all activity that occurs under your account. Specta is not liable for any loss or damage arising from your failure to maintain account security.
4. Inspector Obligations
By registering as an Inspector on Specta, you represent and warrant that you: • Hold all licences, certifications, and qualifications required by applicable state and federal law to perform the inspection types you offer • Carry current professional indemnity and public liability insurance appropriate to your work • Will perform all inspections professionally, diligently, and in accordance with applicable industry standards • Will deliver inspection reports within the timeframe agreed with the Client • Will not misrepresent your qualifications, experience, or the scope of any inspection Specta reserves the right to remove any Inspector who fails to meet these obligations.
5. Inspector Verification
Inspectors are required to submit proof of relevant certifications and qualifications before their profiles are approved. While Specta reviews this information, we do not independently guarantee the accuracy of credentials and are not liable for any misrepresentation by an Inspector. Clients are encouraged to verify inspector credentials independently where appropriate.
6. Client Obligations
By posting an inspection request, you agree to: • Provide accurate information about the property, including its address, type, and any known issues • Ensure the Inspector has lawful access to the property at the agreed time • Respond promptly to Inspector applications and communications • Not request inspections for properties you do not have authority to have inspected Specta is not liable for any delays, costs, or damages arising from inaccurate property information or failure to provide access.
7. Escrow and Payments
When a Client confirms an Inspector, the agreed payment is held in escrow by Specta. Funds are released to the Inspector upon confirmed completion of the inspection and delivery of the report to the Client. If an inspection is not completed, the Client is entitled to a full refund of escrowed funds, subject to any applicable cancellation fees. Specta charges a platform fee on completed transactions. The applicable fee will be clearly disclosed at the time of booking. Platform fees are non-refundable once a transaction is completed. Payments are processed by our third-party payment provider. By making a payment, you agree to that provider's terms of service.
8. Cancellations and Refunds
Clients may cancel a confirmed booking before the inspection takes place and receive a full refund of escrowed funds. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee to compensate the Inspector for lost time. Inspectors who cancel a confirmed booking without reasonable notice may be subject to account review or removal from the platform. 9. Inspection Reports
Inspection reports are prepared by the Inspector and delivered to the Client upon completion of the inspection. Reports are owned by the Client who commissioned them. Specta stores reports on its platform to facilitate delivery, payment release, and dispute resolution. Specta does not edit, verify, or take responsibility for the content of any inspection report. Clients may use their inspection report for personal purposes related to the property in question. Reports must not be provided to third parties for commercial purposes without the Inspector's consent.
10. Intellectual Property
All content on the Specta platform — including its design, code, trademarks, and written content — is owned by or licensed to Specta and may not be reproduced without our written permission. By submitting content to Specta (including profile information, reviews, and messages), you grant Specta a non-exclusive, royalty-free licence to use, display, and distribute that content for the purposes of operating the platform.
11. Prohibited Conduct
You agree not to: • Post false, misleading, or deceptive information on the platform • Circumvent the platform to arrange payments outside of escrow • Harass, threaten, or harm other users • Use Specta for any unlawful purpose • Attempt to reverse-engineer, copy, or disrupt the platform • Create multiple accounts to circumvent a suspension or ban • Solicit users to transact off-platform after an initial connection through Specta Breaches of this section may result in immediate account suspension or termination.
12. Account Suspension and Termination
Specta reserves the right to suspend or terminate any account at any time, with or without notice, if we reasonably believe a user has breached these Terms, engaged in fraudulent or harmful conduct, or posed a risk to other users or the platform. You may close your account at any time by contacting [email protected]. Closure does not affect any outstanding bookings, payments, or obligations. Specta may also discontinue the platform or any part of it at any time, with reasonable notice to users where practicable.
13. Dispute Resolution
If a dispute arises between a Client and an Inspector regarding an inspection or report, both parties should first attempt to resolve it directly. If resolution cannot be reached, either party may contact Specta at [email protected]. Specta will review the matter and may, at its discretion, mediate a resolution — including determining whether escrowed funds should be released, held, or refunded. Specta's determination in any escrow dispute is final and binding on both parties. Specta is not liable for any loss arising from a dispute between users.
14. Indemnification
You agree to indemnify and hold Specta, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the platform, your breach of these Terms, or your interactions with other users.
15. Limitation of Liability
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. Subject to the above, and to the maximum extent permitted by law, Specta is not liable for the quality, accuracy, or completeness of any inspection report, or for any indirect, incidental, or consequential damages arising from your use of the platform. Specta's total liability to you for any claim shall not exceed the total fees paid by you to Specta in the 12 months preceding the claim.
16. Platform Availability
Specta does not warrant that the platform will be available at all times, free from errors, or uninterrupted. We may perform maintenance, updates, or changes to the platform at any time. We will endeavour to provide advance notice of planned downtime where practicable.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under these Terms, without prejudice to our right to seek injunctive relief in any jurisdiction.
18. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed from the remaining Terms, which will continue in full force and effect.
19. Force Majeure
Specta is not liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power outages, or internet service disruptions.
